1. Subject of the contract
claire beauty GmbH sells the goods specified in the online shop to private and business customers (hereinafter referred to as "customer") under the following terms and conditions of delivery and sale (GTC).
2. Conclusion of the contract
The contract between the customer and claire beauty GmbH is only concluded upon receipt of an order from the customer and acceptance of that order by claire beauty GmbH. The customer places the order online. claire beauty GmbH accepts the order by either (a) sending the customer an order confirmation via email or (b) delivering the ordered goods (including a delivery note).
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. All offers are valid "while stocks last." Errors excepted.
By clicking the "Submit Order" button in the final step of the ordering process, the customer places a binding order for the goods contained in the shopping cart. The purchase agreement is concluded when claire beauty GmbH accepts the order by sending an order confirmation via email immediately after receiving the order.
3. Product range
All information regarding the goods that the customer receives during the ordering process is non-binding. In particular, changes in design and technology that improve the functionality of a product, as well as errors in description, illustration, and pricing, are reserved. Acrylic glass/Plexiglas is a thermoplastic, synthetic material. Due to the manufacturing and processing of this material, slight optical variations in structure, in the form of barely visible hairline scratches, may occur. Only the organizer is delivered; decoration and contents are not included.
4. Payment terms
All prices are indicative and are subject to change based on market conditions. They are quoted in Swiss francs (CHF), including VAT (VAT No.: CHE-316.882.023), ex-works, unpacked. Shipping and packaging costs are charged separately. Payment must be made in advance via PayPal, credit card, invoice, or TWINT.
Purchase on account with Billing+:
Credit Check and Scoring: claire beauty GmbH reserves the right to obtain credit information about customers to protect its own interests during the purchase process and may forward customer data to third parties for this purpose. The personal data required for a credit check (first and last name as well as address details) will be transmitted to an external credit agency. CRIF AG, Hagenholzstrasse 81, 8050 Zurich, uses mathematical-statistical methods to assess creditworthiness and creditworthiness. The information obtained regarding the statistical probability of payment default is factored into the decision regarding the establishment, execution, or termination of the contractual relationship. The credit check is carried out in compliance with the relevant data protection regulations and with particular consideration for your legitimate interests. Please note that only CRIF AG can provide information about which data was used to calculate your credit profile.
Purchase on account / Late payment fees: The invoice is payable within 15 days. The invoice is considered paid on time if the amount due is credited to the recipient's account by the end of the payment period. If the payment period is not met and no fixed due date has been agreed upon, the customer will be placed in default by means of a payment reminder. In case of default, the customer will be charged late payment fees (CHF 20.00 for the first reminder and CHF 25.00 for the second). If the claim remains unpaid even after the reminders have been sent, claire beauty GmbH reserves the right to assign the claim to a third party or engage a debt collection agency, at the customer's expense.
Installment payment: With installment payment, you can choose between two or three installments. A fixed fee of CHF 5.00 including VAT will be charged for installment payments, in addition to the order total. We assign the claim to you for the processing of the installment agreement. The installments are payable as follows: 1st installment is due within 10 days of the invoice date; 2nd installment is due within 40 days of the invoice date; 3rd installment is due within 70 days of the invoice date. If an installment payment is missed, the entire outstanding amount becomes due immediately. Example with three installments, for a shopping cart value of CHF 1,500.00: 1st installment CHF 501.65 (CHF 500.00 inventory management fee + CHF 1.65 processing fee) is due within 10 days of the invoice date. 2nd installment CHF 501.65 (CHF 500.00 inventory management fee + CHF 1.65 processing fee) is due within 40 days of the invoice date. 3rd installment CHF 501.70 (CHF 500.00 inventory management fee + CHF 1.65 processing fee) is due within 70 days of the invoice date.
Legal enforcement/collection costs in case of late payment: The amount of legal enforcement/collection costs is calculated based on the outstanding amount: Amount owed in CHF Legal enforcement/collection costs in CHF 0 – 150 max. 80.00, plus 5% default interest 151 – 600 max. 175.00, plus 5% default interest 601 – 1000 max. 230.00, plus 5% default interest 1000.01 – 10,000 max. 860.00, plus 5% default interest from 10,000.01 9% of the outstanding amount, plus 5% default interest
Disclosure of personal data: Your personal data will be disclosed to the transport company commissioned with the delivery or the relevant financial service provider as part of the contract processing, insofar as this is necessary for the delivery or payment of the goods.

5. Delivery
The ordered products can only be shipped to an address in Switzerland, Liechtenstein, Germany, or Austria. If the products are in stock, they will be delivered within 1-2 business days within Switzerland to the address provided by the customer. Otherwise, a written order confirmation will be sent with the expected delivery date. Delivery of the goods is at the customer's expense and risk, even in the case of partial deliveries. Claims for damage to the ordered goods that is externally visible will only be processed upon presentation of a certificate from the postal service. Should an ordered product no longer be available at the time of delivery, claire beauty GmbH expressly reserves the right to replace it with an equivalent product. If the package cannot be delivered and is not collected from the post office within the reasonable timeframe, claire beauty GmbH will charge a handling fee of CHF 20.00.
We ship goods within 1-2 days of receiving your order. Shipping costs within Switzerland and Liechtenstein are a flat rate of CHF 10.50; delivery is free for orders over CHF 129.00. Small packages are sent via Maxi A-Post for CHF 3.40. We ship A-Post packages with DPD or Swiss Post. Of course, there are no shipping costs for training courses.
International shipping:

After you place your order, we will prepare it and inform you as soon as the package is ready for collection. It is also possible, by prior arrangement, for the order to be left in a secure location. Even for collection orders, the processing time is 1-2 business days.
6. Retention of Title
The delivered goods remain the property of claire beauty GmbH until full payment has been received. claire beauty GmbH is entitled to register a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, claire beauty GmbH is entitled to withdraw from the contract (notice of withdrawal) and reclaim the goods.
7. Right of return
The customer has the right to cancel the contract in writing and return the goods within 7 working days. Please return the delivered items undamaged, unused, complete, and in their original, undamaged packaging; otherwise, we will insist on acceptance of the goods.
To meet the cancellation deadline, it is sufficient to send the cancellation notice along with the goods in a timely manner. The cancellation notice should be sent to:

The return period begins upon receipt of the goods by the customer. The customer is also responsible for the return shipping costs. Products specially procured at the customer's request are generally excluded from the return policy. If the customer returns the goods on time and in proper condition, claire beauty GmbH will issue a credit note, a replacement shipment upon request, or a refund of the returned goods' value. Products marked "Clearance Items" cannot be returned!
8. Warranty and Liability
Unfortunately, claire beauty GmbH cannot offer any warranty for products offered in its online shop. Furthermore, claire beauty GmbH is not liable for damages resulting from improper use or normal wear and tear, or for damages not directly related to the delivered item itself (consequential damages).
9. Incomplete delivery
If the ordered goods are delivered incomplete or with a defective product, the customer must notify claire beauty GmbH within 5 working days of receiving the goods. claire beauty GmbH will then offer the customer a replacement.
10. Training
Registration for the training course via the claire beauty GmbH training website is binding. After registration, participants will receive written confirmation along with payment confirmation. The amount must be paid directly at the time of booking by credit card, PayPal, or Twint. If the course is booked in writing via email, WhatsApp, or Facebook, the amount must be paid within 7 days, or a partial payment can be agreed upon in advance. The participation fee must be paid in full before the seminar in all cases. If a participant cannot attend the training, they must cancel in a timely manner. In any case, claire beauty GmbH will charge a cancellation fee.CHF 200.00, which will be taken into account during the refund process. The amount paid will be refunded as follows:
Up to 15 days before the training: Full amount after deduction of the CHF 200.00 processing fee.
14 – 8 days before the training: 60% of the amount after deduction of the CHF 200.00 processing fee.
7 – 0 days before the training: The amount will no longer be refunded.
In case of urgent cancellations, such as illness, claire beauty GmbH may suggest an alternative date. claire beauty GmbH may cancel a course at short notice, up to 5 days in advance, if there are too few registrations. After this time, an alternative date will be suggested, or the full amount will be refunded.
11. Online training / online exam
Registration for the online training/online exam is binding. It is not possible to withdraw from the contract after booking.
Online training: After watching all videos and marking them as completed, the certificate will be automatically generated for download. The certificate will be issued personally with your name and the current date. Online exam: The customer is not bound to a specific appointment and can complete the theoretical and practical exam from home on a mobile device if needed. Participants have two attempts per exam. If the exam is failed after the second attempt, the customer must register again for a further attempt at a cost. Should a technical problem occur on the part of claire beauty GmbH during the exam, the participant must inform claire beauty GmbH immediately in writing. The nail design online exam can only be taken and passed if the book "The Great Nail Design School" has been read thoroughly and the practical exercises have been practiced at home. claire beauty GmbH assumes no liability for nail enhancements performed at home. After passing the online exam, the participant will receive a personal certificate by mail within a few days. Exam results are kept strictly confidential by claire beauty GmbH and will not be shared with third parties. Likewise, documents and photos uploaded by participants will be treated confidentially.
12. Bonus program
All registered customers of the shop are eligible to participate. Participation is free.
Customers collect Nail Points with every purchase. One Nail Point is credited for every Swiss franc spent. An additional 20 Nail Points are awarded for each product review. Nail Points are only credited for fully paid and non-returned orders.
12.1. Redeeming Nail Points
Nail Points can be redeemed for selected free products or discounts. Your point balance can be viewed in your customer account. Cash payment is not possible. Nail Points are non-transferable.
12.2 Validity and Expiry
Nail Points are valid indefinitely from the date they are credited. Unused Nail Points do not expire.
The shop may change or discontinue the bonus program at any time. Participants will be notified of changes via email or the website. If the program is discontinued, collected Nail Points can be redeemed within a reasonable timeframe.
13. Surprise Box Subscription
13.1 Conclusion
By clicking the "Pay" button in the final step of the ordering process (checkout), the customer submits a binding offer to conclude a contract with claire beauty GmbH. This offer is binding and irrevocable, and the contract is considered concluded upon acceptance by claire beauty GmbH.
13.2 Contract duration
The Claire Beauty Surprise Box subscription is for an indefinite period. Unless cancelled, it will automatically renew for another month.
13.3 Contract Termination
You can cancel your Surprise Box subscription at any time in your customer account. Log in to your customer account in the claire beauty shop and manage your subscription under the "Subscription" section. If you have already paid for the current month's box, the subscription will be automatically canceled for the following month.
13.4 Payment
The Surprise Box subscription must be paid in advance by credit card or PayPal. The payment for the next Surprise Box will then be automatically processed on the same date each month (the date of subscription). The Surprise Box is always delivered on the 25th of each month. Therefore, depending on the subscription date, the payment may be processed days or even weeks before delivery.
13.5 Prices & Delivery
The Surprise Box costs CHF 34.90 per month including VAT. A delivery fee of CHF 4.90 including VAT applies. The box is automatically sent to the address you provided during the subscription process on the 25th of each month. Shipping is only available within Switzerland and Liechtenstein. We ship via standard mail with our partner, Swiss Post. The actual delivery date may be delayed by 2-3 days due to unforeseen circumstances.
14. Coaching
Registration for coaching is binding. Immediately after registration, the client receives a contract and an invoice detailing the full coaching fees. Once the contract is returned in full and the fees are paid, the coaching begins. All documents and information are treated confidentially by claire beauty GmbH and will not be shared with third parties. All details are stipulated in the coaching contract between claire beauty GmbH and the client. If the coaching fees have been paid, or the coaching contract signed, and the client terminates the coaching before it begins, a processing fee of CHF 400.00 is due. Once the coaching has commenced, the client can no longer withdraw from the contract, and the full fees are owed.
15. Studio Partner Program
Any nail salon owner can participate in the Studio Partner Program. Registration and participation are free.
15.1 Registration
Registration is completed by filling out the registration form in the online shop, providing company details. After verification of the information, the participant will be activated as a studio partner.
15.2 Discount
As a studio partner, you receive a 10% discount on every order. This discount is automatically applied to each order. Studio partners have access to exclusive special offers and a pre-emption right for new products. There is no minimum order quantity, no minimum sales volume, and no mandatory investment.
15.3 Duration and Termination
The discount and participation in the program are valid indefinitely. Cancellation is possible at any time without notice.
15.4 Loyalty Program
Studio partners can also participate in the bonus program and collect Nail Points for free products.
16. Intellectual Property
Claire beauty GmbH reserves all rights to every design, text, and graphic on its website. Copying or any other reproduction of the entire website or parts thereof is permitted only for the purpose of placing an order with Claire beauty GmbH. The name Claire beauty GmbH, all page headers, navigation bars, graphics, and button icons are registered trademarks, trade names, or service marks of Claire beauty GmbH. All other trademarks, product names, company names, or logos cited on this website are the sole property of their respective owners.
17. Data protection
Claire Beauty GmbH assures that it complies with the provisions of the Swiss Federal Act on Data Protection and other applicable legal regulations when collecting, processing, and using personal data. Customer data collected during order processing is used solely for internal market research purposes. Data is only shared with third-party partner companies to the extent absolutely necessary for the proper fulfillment of the order. The customer consents to this use of their data. Furthermore, the customer has the right, upon request, to access their stored data and to prohibit its use for internal market research purposes.
18. Jurisdiction and applicable law
These terms and conditions and the contracts concluded on the basis of these terms and conditions are subject to Swiss law. The place of jurisdiction is Solothurn.
19. Final Provisions
The sale of goods specified in the online shop of claire beauty GmbH is governed exclusively by the General Terms and Conditions (GTC) in their version valid at the time of the respective contract conclusion. These terms and conditions apply even if they differ from those of the customer. Furthermore, claire beauty GmbH reserves the right to amend these General Terms and Conditions at any time.
